This is fototrekn, the best place on the web to plan your next photo excursion. We are all about providing you, the fototreker, a safe and easy to use place to post your best travel pictures and to research that next great trek. For the most part, we are going to provide you this great service and then stay out of your way, we think it works best that way. However, there are a few rules we all need to abide by to make this the best experience possible for everyone.
All visitors and subscribers to fototrekn are bound by these Terms and Conditions.
Perpetual Beta
You may not have ever heard this term. Simply stated, we are and will continue to evolve this site pretty much on a continual basis. Because much of the content is user input, it will probably change every day. Additionally, we will be releasing new features from time to time. We will do this randomly and usually without any advance notice. The site will simply get better hopefully every time you log in. So don't be surprised if things change and change often.
Copyright
There are two types of content on fototrekn, the content inherent in the construction and operation of the site ("inherent content") and the content uploaded by the fototrekn community ("community content"). All "inherent content" is the sole property of fototrekn. You can not duplicate, download, copy, decomplile, reproduce or resell the "inherent content" without the express written consent of fototreken. "community content" remains the property of the subscriber who submitted the content. Implicit in that ownership is the assumption that the subscriber has the authority to place the content on fototreken for use by fototreken and the subscriber/user base. The subscriber is responsible for placing appropriate copyright marks on images to be uploaded and agrees never to upload an image that they do not own the rights to.
Use of Images
All users grant fototrekn a non-exclusive right to post and display uploaded images in all means supported by the site. If the images are uploaded to a public gallery, it is understood that the images can be viewed by any person accessing the fototrekn site. It the images are in a private gallery, then the images can be viewed by persons authorized by the gallery owner and can also be viewed by fototrekn administrative staff.
Additionally, users grant to fototrekn a non-exclusive right to use any image uploaded to a public gallery and grant fototrekn the right to use the image to promote the fototrekn site. This will include but is not limited to promotion within the site such as use in Treks, inclusion in Most Viewed, Recent Uploads and outside the site in promotional literature and advertising.
Objectionable Material
This is a family friendly site. No objectionable or offensive material will be allowed. fototrken reserves the right at its sole discretion to remove any material it deems objectionable or offensive. Examples of objectionable or offensive material include nudity, graphic depictions of violence or any material that subjugates a person or class of people.
No Guarantee of Service
We cannot guarantee any specific level of service, we do promise to offer the best level of service we can, but that is all we can offer. You should always have your photos backed up and never rely on just one location or source.
Termination
You kinda knew we had to have this one. We reserve the right to terminate your account at any time and for any reason, with or without cause. If you are a paid subscriber, we will refund any prorated amount of your subscription that is remaining. We also agree to terminate your account upon your request. In that case, no refund will be made.
